This Privacy Policy explains how Trio AMD Technologies LLP (“we,” “us,” or “our”) collects, uses, discloses, and safeguards personal data when you (“User,” “you,” or “your”) access or use the CarBikeMart mobile application and related websites (collectively, the “App”). It should be read together with our Terms & Conditions. By using the App, you consent to the practices described here. If you do not agree, please discontinue use.
We collect information you provide directly, such as your name, email address, phone number, WhatsApp number, business details (registered name, PAN, GST, TAN, Aadhaar), address, uploaded documents (visiting card, KYC), and vehicle listing details. When you use the App, we automatically collect device identifiers, IP address, operating system, network information, in-app usage events, crash reports, and approximate location (where you have granted permission). With your explicit consent we may also access your camera, photo library, contacts, and precise location strictly for features you initiate (uploading a photo, sharing a listing, calculating distance to a vehicle).
We use your information to create and authenticate your account, verify identity and KYC, publish and manage vehicle listings, facilitate offers and communications between buyers, sellers, brokers, and dealers, process payments, provide customer support, personalize your feed, send transactional and marketing communications (which you can opt out of), detect and prevent fraud or abuse, comply with legal obligations, and improve App performance and features. We do not use your data for automated decisions that produce legal or similarly significant effects without human review.
We process your data under the following legal bases as applicable under the Digital Personal Data Protection Act, 2023 (India) and other applicable laws: (a) your consent, where required; (b) performance of a contract with you; (c) compliance with a legal obligation; (d) our legitimate interests in operating and improving the platform, provided they are not overridden by your rights; and (e) protecting vital interests or public interest where relevant.
We share your information with: (i) other registered users to the extent required to complete a transaction you initiated (for example, a buyer sees a seller's contact once an offer is accepted); (ii) service providers who host our servers, send OTPs, deliver emails, process payments, run analytics, provide cloud storage, or perform KYC/CIBIL/vehicle-history checks — bound by confidentiality; (iii) law enforcement, courts, or regulators where legally required; (iv) potential acquirers in the event of a merger, acquisition, or restructuring, subject to equivalent protections. We do not sell your personal data.
The App and any linked websites use cookies, local storage, and analytics SDKs (such as crash reporting and product analytics) to remember preferences, keep you signed in, and measure usage. You can manage or clear these through your device and browser settings. Turning them off may affect App functionality.
We retain your personal data only as long as needed for the purposes described in this policy or as required by law (for example, tax, audit, dispute resolution, and fraud-prevention obligations). Listings, transaction records, and KYC documents may be retained for the duration required by applicable financial and regulatory rules, after which they are deleted or anonymised.
Subject to applicable law, you have the right to access, correct, update, or request deletion of your personal data; withdraw consent where processing is consent-based; port your data; restrict or object to certain processing; and lodge a complaint with the Data Protection Board of India. To exercise these rights, email business@carbikemart.com from your registered email. We may need to verify your identity before acting on a request and will respond within statutory timelines.
We use industry-standard safeguards — encryption in transit (TLS), encrypted storage for sensitive fields, access controls, audit logs, and regular security reviews — to protect your data. Payment information handled by third-party processors is not stored on our servers. No system is completely secure; you are responsible for protecting your login credentials and notifying us immediately at business@carbikemart.com if you suspect any unauthorised use of your account.
The App is intended for users who are at least 18 years old. We do not knowingly collect personal data from minors. If you believe a minor has provided us data, contact us and we will delete it promptly.
Your data is primarily stored and processed in India. Where a service provider processes data outside India, we ensure contractual safeguards consistent with Indian law and do not transfer data to any country restricted by the Government of India.
The App integrates with third-party services such as payment gateways, mapping providers, communication platforms (SMS/WhatsApp/email), and analytics tools. These providers process data under their own privacy policies. We are not responsible for their practices and encourage you to review their policies before using linked features.
With your consent, we may send promotional emails, SMS, WhatsApp messages, or push notifications about listings, offers, and new features. You can opt out anytime by using the unsubscribe link in emails, replying STOP to SMS/WhatsApp, or adjusting notification settings in the App. Transactional messages (OTP, account, and transaction alerts) will continue as they are necessary for the service.
In accordance with the Information Technology Act, 2000 and Rules made thereunder, we have designated a Grievance Officer. You may write to the Grievance Officer at business@carbikemart.com regarding any concern about this policy or the processing of your personal data. We will acknowledge your grievance within 48 hours and endeavour to resolve it within 30 days.
We may update this Privacy Policy from time to time to reflect changes in law, technology, or our services. Material changes will be notified via the App or email at least 7 days before they take effect. Continued use of the App after the effective date constitutes acceptance of the revised policy.
