By downloading, installing, accessing, or using this Android mobile application (“App”), developed and provided by Trio AMD Technologies LLP (“we,” “us,” or “our”), you (“User,” “you,” or “your”) agree to be bound by these Terms and Conditions (“Terms”). These Terms constitute a legally binding agreement between you and us. If you do not agree with any part of these Terms, you must not download, install, or use the App. Your continued use of the App after any modifications constitutes acceptance of those changes. These Terms incorporate our Privacy Policy by reference, which details how we handle your personal data.
Only individuals who are at least 18 years old and legally competent to enter into binding contracts under the laws of India may use the App. Minors, undischarged insolvents, or those previously banned are ineligible. Businesses must register through authorized representatives with legal authority to bind the entity. During registration, you must provide accurate, current, and complete information, including name, email, phone number, and any other required details. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately of any unauthorized use. We reserve the right to suspend or terminate accounts for violations, suspected fraud, or incomplete information.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on a single authorized Android device owned or controlled by you for your personal, non-commercial use. This license does not permit use on emulators, jailbroken devices, or for creating derivative works. You may not: (i) copy, modify, reverse engineer, decompile, disassemble, or attempt to derive the source code of the App; (ii) distribute, sublicense, rent, lease, or commercially exploit the App; (iii) remove or alter any proprietary notices; (iv) use the App in violation of export control laws; or (v) circumvent technological measures protecting the App. Any attempt to do so automatically terminates the license.
You retain ownership of any content you submit, post, or transmit via the App (“User Content”), such as profiles, listings, reviews, messages, or photos. By submitting User Content, you grant us a worldwide, perpetual, irrevocable, royalty-free, sub-licensable license to use, reproduce, modify, distribute, display, and perform it for operating, promoting, and improving the App. User Content must not: violate laws or third-party rights; be defamatory, obscene, harassing, or harmful; contain viruses or malware; promote illegal activities; or impersonate others. We may review, remove, or refuse User Content at our discretion without notice. You represent that you own or control all rights in User Content and have authority to grant the above license.
The App facilitates vehicle buying and selling between owners, dealers, and verified buyers. You agree to use the App only for lawful purposes and in compliance with these Terms. Prohibited activities include: posting false or misleading information; manipulating ratings, prices, or transactions; harassing users; spamming; unauthorized data scraping; using automated tools like bots or scripts; interfering with App functionality; or engaging in fraudulent transactions. For classified listings or peer-to-peer interactions, verify counterparties independently — we act solely as a platform and bear no responsibility for transactions, disputes, or user conduct. Report violations promptly.
Access to basic features is free, but premium features, listings, or in-app purchases may incur fees payable via Google Play Store or integrated processors. All fees are in Indian Rupees (INR), exclusive of taxes (which you bear). Fees are non-refundable except as required by applicable law or Google Play policies. Subscriptions auto-renew unless cancelled at least 24 hours before renewal. We may change fees with 30 days’ notice via the App or email. Late payments may result in suspension. You authorize us to charge your payment method and handle disputes with payment providers.
The App, including code, design, logos, trademarks, and content (excluding User Content), is owned by us or our licensors and protected by Indian and international copyright, trademark, and other laws. No use of the App grants you any ownership rights. Third-party materials integrated into the App (e.g., photos, payment gateways) are subject to their own terms. Infringing our rights may lead to legal action.
The App may integrate or link to third-party services like Google Play, payment processors, analytics tools, or external sites. Your use of these is at your own risk, governed by their terms and policies. We are not liable for their content, privacy practices, or availability. Permissions granted to third-parties (e.g., location access) are managed via device settings.
We may update the App automatically or require manual downloads for bug fixes, security, or features. You consent to such updates. The App may be unavailable for maintenance or due to technical issues. We strive for reliability but provide no guarantees of uninterrupted access.
We may suspend or terminate your access immediately for breaches, without liability. Upon termination, your license ends; delete the App and cease use. Surviving provisions include ownership, liability limits, indemnity, and governing law. You may terminate by uninstalling the App.
The App is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, express or implied, including merchantability, fitness for purpose, or non-infringement. We disclaim liability for viruses, data loss, inaccuracies, or interruptions. To the fullest extent permitted by law, our total liability shall not exceed INR 1,000 or fees paid by you in the prior 12 months, whichever is greater. No liability for indirect, incidental, consequential, or punitive damages, including lost profits or data.
You agree to indemnify, defend, and hold harmless us, affiliates, officers, directors, employees, and agents from claims, losses, damages, costs (including attorney fees) arising from your breach of Terms, User Content, or violation of laws/third-party rights.
Neither party is liable for delays due to events beyond reasonable control, such as acts of God, strikes, wars, pandemics, or government actions.
These Terms are governed by the laws of India, excluding conflict principles. Any disputes shall be resolved exclusively by courts in Mumbai, Maharashtra. You waive objections to venue/jurisdiction.
We may update these Terms anytime, posting the new version in the App with a notice of changes. Continued use after 30 days constitutes acceptance.
If any provision is invalid, the remainder remains enforceable. No waiver of rights is implied by inaction.
These Terms, with our Privacy Policy, form the entire agreement. No third-party beneficiaries. Electronic signatures and notices via App/email suffice.
